NOTICE OF PROPOSAL FOR REGULATION

Proposal Title:

The proposed regulation made under the Building 
Code Act, 1992 will establish a new Building Code 
that will replace the existing Building Code (O. Reg 403/97).



Short Description:

Objective-Based Format for the Next Edition of Ontario’s Building Code:

The proposed regulation will adopt a new version 
of Ontario’s Building Code (the 2006 Building 
Code), which relates to the construction of 
buildings generally, including the construction of sewage systems.

The new Building Code will be written in an 
objective-based format. For sewage systems, this 
means that the new Building Code will retain the 
existing prescriptive requirements for sewage 
systems, but will provide for performance-based 
compliance through the inclusion of objectives 
for the technical provisions. This blend of 
prescriptive and performance-based requirements 
assures certainty and continuity but will also 
allow for more flexibility and innovation in 
design and construction of sewage systems.

The proposed regulation will revoke the current 
Building Code regulation (O. Reg. 403/97), which it replaces.

Effluent Filters:

The proposed regulation will require the 
inclusion of effluent filters in new septic tank 
installations. Effluent filters are devices 
typically installed at the outlet of the septic 
tank to prevent the passing of solid particles 
from the septic tank into the leaching bed. The 
use of effluent filters provides an additional 
measure to improve the functioning of on-site 
sewage systems, prevent premature system 
deterioration and could reduce the likelihood of 
contamination of groundwater resources.

Purpose of the Proposal:

The purpose of this proposal is replace the 
existing Building Code regulation with a new 
Building Code regulation written in an 
objective-based format which will provide for 
performance-based compliance, including the 
construction of sewage systems, through the 
inclusion of objectives for the technical 
provisions, and which will require the inclusion 
of effluent filters in new septic tank installations.



Other Public Consultation:

The Ministry conducted extensive public 
consultation in 2001 and again in 2003, including 
web-based consultations, in respect of the proposed new Building Code.
