It will:<o:p></o:p></p><ul style='margin-top:0cm' type=disc><li class=MsoNormal style='mso-list:l4 level1 lfo1'>describe the human rights issues we heard about from more than 1,500 individuals <br><span style='letter-spacing:-.1pt'>and organizations across Ontario</span> <o:p></o:p></li><li class=MsoNormal style='mso-list:l4 level1 lfo1'><span style='letter-spacing:-.1pt'>recommend</span> action for <span style='letter-spacing:-.2pt'>government, public and private sector organizations <br>to eliminate discrimination</span> in housing, employment and services <o:p></o:p></li><li class=MsoNormal style='mso-list:l4 level1 lfo1'><span style='letter-spacing:-.1pt'>include OHRC commitments for action.</span> <o:p></o:p></li></ul><p class=MsoNormal><o:p> </o:p></p><p class=MsoNormal>This report will also help guide our next project: a policy on human rights, mental health and addictions. People told us that there seemed to be different standards for dealing with mental health-related disabilities compared with physical disabilities at work. We also heard how people’s experience of discrimination was unique or distinct when they had multiple disabilities or identified with additional<i> Code </i>grounds like race or ancestry. <o:p></o:p></p><p class=MsoNormal><o:p> </o:p></p><p><span style='font-family:"Arial","sans-serif"'>We intervened in <i>Seberras v. the Workplace Safety and Insurance Board. </i></span> <span lang=EN style='font-family:"Arial","sans-serif"'>This case involves looking at whether the WSIB’s Traumatic Mental Stress policy and related provisions of the <i>Workplace Safety and Insurance Act</i> are discriminatory because they have extra requirements for mental health claims that are not needed for other kinds of workplace injuries.<o:p></o:p></span></p><p class=MsoNormal><span lang=EN><o:p> </o:p></span></p><p class=MsoNormal><span style='color:black'>We are also exploring how mental health disabilities and addictions </span>intersect with other <i>Code</i> grounds such as ethnicity, creed (religion) and race. We plan to intervene in a case at the Tribunal that links discrimination based on race, use of restraints and care for racialized people within the mental health system. <span style='color:blue'><o:p></o:p></span></p><p class=MsoNormal><o:p> </o:p></p><h2><span style='font-size:12.0pt;font-style:normal'>Zoning in on NIMBYism<o:p></o:p></span></h2><p class=MsoNormal><span style='color:black;background:white'>In February, we published<span class=apple-converted-space> </span></span><i><span style='color:blue'><a href="http://www.ohrc.on.ca/en/resources/Guides/inthezone"><span style='border:none windowtext 1.0pt;padding:0cm;background:white'>In the zone</span></a></span></i><span style='color:black;background:white'>, a guide to housing, human rights and municipal planning. The guide describes the barriers created when municipalities pass bylaws that restrict the location of housing for people identified by <i>Code </i>grounds, including people with mental health disabilities and addictions. <i>In the zone</i> offers “best practices” to promote housing and zoning that is free from discrimination. Copies of <i>In the zone</i> were sent to every municipality in Ontario. We also sent copies to planning schools and organizations across the province and to many others working on municipal housing issues.<o:p></o:p></span></p><p class=MsoNormal><o:p> </o:p></p><p><span lang=EN style='font-family:"Arial","sans-serif"'>We continue to take part in cases that challenge zoning rules that limit options for affordable and supportive housing for people with mental health or other disabilities. <br>For example, we are intervening </span><span style='font-family:"Arial","sans-serif"'>at the Human Rights Tribunal of Ontario</span><span lang=EN style='font-family:"Arial","sans-serif"'> in a</span><span style='font-family:"Arial","sans-serif"'>n application against the City of Toronto. Other parties in this case are <a href="http://www.thedreamteam.ca/home">The Dream Team</a> (an organization led by psychiatric consumer/survivors), the Advocacy Centre for Tenants Ontario (ACTO) and the Human Rights Legal Support Centre. We are also intervening with the same partners in Tribunal cases against the cities of Smiths Falls and Kitchener.<o:p></o:p></span></p><p class=MsoNormal><o:p> </o:p></p><p class=MsoNormal>Each case involves complaints about minimum separation distances and other zoning issues, and raises concerns that municipal bylaws create barriers for group homes for people with mental health issues and intellectual disabilities. <o:p></o:p></p><p class=MsoNormal><o:p> </o:p></p><p class=MsoNormal>We’re also monitoring a situation in Hamilton where a minimum separation distance rule has kept the Lynwood Charlton group home for eight teenaged girls with mental illness from moving to a better location. The home needs extensive structural repairs that it cannot afford to make. The Lynwood Charlton Centre owns another suitable building a few blocks away.<o:p></o:p></p><p class=MsoNormal><o:p> </o:p></p><p class=MsoNormal>Hamilton Council turned down their zoning application to move the residents, saying there were too many residential care facilities in the area. Chief Commissioner Barbara Hall has written <a href="http://www.ohrc.on.ca/en/news_centre/re-information-report-lynwood-charlton-centre-cm12005">two letters</a> to the City of Hamilton asking the city to carefully consider <span style='color:black;background:white'>the human rights impacts on the vulnerable people who already live and use services <br>in that community. </span><o:p></o:p></p><p class=MsoNormal><o:p> </o:p></p><p class=MsoNormal>Chief Commissioner Hall has also <a href="http://www.ohrc.on.ca/en/news_centre/re-proposed-official-plan-and-zoning-law-amendment-methadone-clinics-0">raised human rights questions with the City of London</a> o<span lang=EN>n proposed amendments to their Official Plan and Zoning By-Law that would treat methadone clinics differently than other medical clinics. She </span><span style='color:black;background:white'>commended the City for making effective service delivery to people who need methadone treatment a central goal in its work, but said that elements of the proposed amendments “may actually work against [that] goal, and against the human rights of persons with disabilities who require <span style='letter-spacing:-.1pt'>methadone treatment.” We are looking further into zoning practices that affect methadone</span> clinics, including minimum separation distances and gross floor area requirements.<o:p></o:p></span></p><p class=MsoNormal><span style='color:blue'><o:p> </o:p></span></p><h2><span style='font-size:12.0pt;font-style:normal'>Exchanging knowledge and expertise<o:p></o:p></span></h2><p class=MsoNormal><span style='color:black'>Public education is an important way for us to address and try to prevent mental health and addiction-related discrimination. We have worked with several organizations to deliver training and make presentations on the <i>Human Rights Code</i>, mental health, discrimination, and the duty to accommodate. <o:p></o:p></span></p><p class=MsoNormal><span style='color:black'><o:p> </o:p></span></p><p class=MsoNormal>In October 2011, we met with human rights commissions from across Canada and the <a href="http://www.workplacestrategiesformentalhealth.com/">Great West Life Centre for Mental Health</a>, to talk about human rights issues in the workplace for people with mental health issues and addictions. These organizations plan to develop tools that will help human rights commissions and employers address human rights and accommodation issues at work for people with mental health disabilities. <o:p></o:p></p><p class=MsoNormal><o:p> </o:p></p><p class=MsoNormal>In April, we provided training for adjudicators at <a href="http://www.elto.gov.on.ca/english/default.html">Environment and Land Tribunals of Ontario </a>on the duty to accommodate people with invisible disabilities, including mental health. <o:p></o:p></p><p class=MsoNormal><o:p> </o:p></p><p class=MsoNormal>In May, we attended and presented at “Mad-Positive in the Academy: An International Dialogue on Practice” with the <a href="http://www.ryerson.ca/ds/">Ryerson School of Disability Studies</a>. Activists and academics from four different countries discussed “mad” theory and practice, including how to bring the knowledge of consumer/survivor researchers into academia. We spoke about human rights and responsibilities in housing, and how the Ontario <i>Human Rights Code</i> applies to hoarding. <o:p></o:p></span></p><p class=MsoNormal><span style='color:black'><o:p> </o:p></span></p><p class=MsoNormal><span style='color:black'>Plans are underway to train staff at the <a href="http://www.schizophrenia.on.ca/">Schizophrenia Society of Ontario</a> (SSO) on rights and responsibilities under the Ontario <i>Human Rights Code. </i>The SSO helps people affected by schizophrenia and psychotic illnesses. They also deliver educational training to professionals and the larger community. <o:p></o:p></span></p><p class=MsoNormal><span style='color:black'><o:p> </o:p></span></p><p class=MsoNormal><span style='color:black'>We are also working with the <a href="http://www.toronto.cmha.ca/">Canadian Mental Health Association</a> (CMHA), Toronto Branch on their “<a Des gens nous ont dit qu’il semble y avoir des normes différentes quant aux façons de composer avec les troubles mentaux comparativement aux handicaps physiques au travail. Nous avons aussi entendu des gens expliquer en quoi leur expérience de la discrimination était unique ou distincte lorsqu’ils avaient des handicaps multiples ou qu’ils étaient identifiés en fonction d’autres motifs de discrimination interdits en vertu du <i>Code</i>, comme la race ou l’ascendance.<o:p></o:p></span></p><p class=MsoNormal><span lang=FR-CA><o:p> </o:p></span></p><p><span lang=FR-CA style='font-family:"Arial","sans-serif";letter-spacing:-.1pt'>Nous sommes intervenus dans l’affaire <i>Seberras v. the Workplace Safety and Insurance</i></span><i><span lang=FR-CA style='font-family:"Arial","sans-serif"'> Board. </span></i><span lang=FR-CA style='font-family:"Arial","sans-serif"'>Cette affaire visait à déterminer si la politique sur le stress traumatique de la CSPAAT et les dispositions connexes de la <i>Loi sur la sécurité professionnelle et l’assurance contre les accidents du travail</i> sont discriminatoires parce qu’elles imposent des exigences additionnelles que les personnes ayant d’autres types de lésions liées au travail ne sont pas tenues de remplir.<o:p></o:p></span></p><p class=MsoNormal><span lang=FR-CA><o:p> </o:p></span></p><p class=MsoNormal><span lang=FR-CA style='color:black'>Nous examinons également comment les <span style='background:white'>troubles mentaux et dépendances</span> recoupent d’autres motifs de discrimination </span><span lang=FR-CA>interdits par le <i>Code</i> tels que l’origine ethnique, la croyance (religion) et la race. Nous prévoyons intervenir auprès du Tribunal dans une affaire où il est question de discrimination fondée sur la race, de l’usage de moyens de contention et de racialisation des soins aux particuliers dans le système de soins de santé mentale.<span style='color:blue'><o:p></o:p></span></span></p><p class=MsoNormal><span lang=FR-CA><o:p> </o:p></span></p><h2><span lang=FR-CA style='font-size:12.0pt;font-style:normal'>Pour sortir de la zone du « pas dans ma cour »<o:p></o:p></span></h2><p class=MsoNormal><span lang=FR-CA style='color:black;background:white'>En février, nous avons publié </span><i><span lang=FR-CA style='color:blue'><a href="http://www.ohrc.on.ca/fr/dans-la-zone-logement-droits-de-la-personne-et-planification-municipale"><span style='border:none windowtext 1.0pt;padding:0cm;background:white'>Dans la zone</span></a></span></i><span lang=FR-CA style='color:black;background:white'>, un guide sur le logement, les droits de la personne et la planification municipale. Ce guide explique les obstacles qui sont créés lorsque les municipalités adoptent des règlements qui limitent l’emplacement de logements pour les personnes visées par les motifs de discrimination interdits par le <i>Code</i>, notamment les personnes aux prises avec des troubles mentaux et des dépendances. <i>Dans la zone</i> offre des « pratiques exemplaires » pour favoriser le logement et le zonage exempts de discrimination. Des exemplaires du guide <i>Dans la zone</i> ont été envoyés à toutes les municipalités de l’Ontario. Nous en avons aussi envoyé aux écoles d’urbanisme et organismes œuvrant dans ce domaine dans toute la province, ainsi qu’à de nombreux autres intervenants intéressés par les questions touchant le logement municipal.<o:p></o:p></span></p><p class=MsoNormal><span lang=FR-CA><o:p> </o:p></span></p><p><span lang=FR-CA style='font-family:"Arial","sans-serif"'>Nous continuons de participer à des affaires de contestation de règlements de zonage qui limitent les options de logements abordables et logements avec services de soutien offertes aux personnes aux prises avec des troubles mentaux ou autres handicaps. Par exemple, nous intervenons devant le Tribunal des droits de la personne de l’Ontario dans le cadre d’une requête contre la Ville de Toronto. D’autres parties dans cette cause sont <a href="http://thedreamteam.ca/">The Dream Team</a> (organisme dirigé par d’anciens usagers de services psychiatriques), le Centre ontarien de défense des droits des locataires et le Centre d’assistance juridique en matière de droits de la personne. Nous intervenons également devant le Tribunal avec les mêmes partenaires dans d’autres causes contre les villes de Smiths Falls et de Kitchener.<o:p></o:p></span></p><p class=MsoNormal><span lang=FR-CA><o:p> </o:p></span></p><p class=MsoNormal><span lang=FR-CA>Chaque cas implique une plainte à propos de la distance minimale de séparation et <span style='letter-spacing:-.1pt'>d’autres questions de zonage, et soulève des préoccupations à l’effet que les règlements </span>municipaux créent des obstacles pour les foyers de groupe pour personnes ayant des troubles mentaux et des handicaps intellectuels. <o:p></o:p></span></p><p class=MsoNormal><span lang=FR-CA><o:p> </o:p></span></p><p class=MsoNormal><span lang=FR-CA>Nous surveillons également une situation ayant cours à Hamilton où un règlement prévoyant une distance minimale de séparation empêche le foyer de groupe Lynwood Charlton pour huit adolescentes atteintes de troubles mentaux de déménager à un endroit plus approprié. Le foyer a besoin de nombreuses réparations structurelles qu’il n’a pas les moyens de financer, alors que le Centre Lynwood Charlton est propriétaire d’un autre immeuble situé à quelques rues seulement.<o:p></o:p></span></p><p class=MsoNormal><span lang=FR-CA><o:p> </o:p></span></p><p class=MsoNormal><span lang=FR-CA>Le conseil municipal de Hamilton a rejeté la demande de modification de zonage permettant de déménager les résidentes, statuant qu’il y a de trop nombreux établissements de soins résidentiels dans le secteur. La commissaire en chef Barbara Hall a écrit <a href="http://www.ohrc.on.ca/en/news_centre/re-information-report-lynwood-charlton-centre-cm12005">deux lettres</a> à la Ville de Hamilton pour lui demander de tenir compte des conséquences de cette décision sur le plan des <span style='color:black;background:white'>droits fondamentaux des personnes vulnérables qui vivent déjà dans cette collectivité et utilisent les services qui y sont offerts.</span><o:p></o:p></span></p><p class=MsoHeader><span lang=FR-CA><o:p> </o:p></span></p><p class=MsoNormal><span lang=FR-CA>La commissaire en chef Hall a aussi <u><span style='color:blue'><a href="http://www.ohrc.on.ca/fr/centre_des_nouvelles/objet-proposition-de-modification-au-plan-officiel-et-au-r%C3%A8glement-de-zonage-cliniques-de-m%C3%A9thadone">soulevé auprès de l’administration municipale de London des questions touchant les droits de la personne</a></span></u> relativement aux modifications proposées au plan officiel et au règlement de zonage de la Ville, lesquelles auraient pour effet de traiter les cliniques de traitement à la méthadone différemment des autres cliniques médicales. Elle a félicité la Ville d’avoir fait de la prestation efficace de services aux personnes nécessitant des traitements à la <span style='color:black;background:white'>méthadone un objectif central de son travail, mais a dit craindre « </span>que certains éléments des modifications proposées <span style='letter-spacing:-.1pt'>n’aillent à l’encontre de cet objectif et des droits des personnes handicapées nécessitant</span> un traitement à la méthadone »<span style='color:black;background:white'>. Nous examinons les pratiques en matière de zonage qui touchent les cliniques de traitement à la méthadone, notamment les exigences relatives aux distances minimales de séparation et aux surfaces de plancher brutes.</span><o:p></o:p></span></p><p class=MsoNormal><span lang=FR-CA style='color:blue'><o:p> </o:p></span></p><h2><span lang=FR-CA style='font-size:12.0pt;font-style:normal'>Mise en commun de connaissances et d’expertise<o:p></o:p></span></h2><p class=MsoNormal><span lang=FR-CA style='color:black'>La sensibilisation du public est une façon importante pour nous d’aborder la discrimination fondée sur la santé mentale et les dépendances, et de tenter de la prévenir. Nous avons collaboré avec plusieurs organisations à offrir une formation et à faire des présentations sur le <i>Code des droits de la personne</i>, la santé mentale, la discrimination et l’obligation d’accommodement.<o:p></o:p></span></p><p class=MsoNormal><span lang=FR-CA style='color:black'><o:p> </o:p></span></p><p class=MsoNormal><span lang=FR-CA>En octobre 2011, nous avons rencontré des représentants des commissions des droits de la personne de partout au Canada et du <span style='color:blue'><a href="http://www.workplacestrategiesformentalhealth.com/">Centre pour la santé mentale en milieu de travail de la Great-West</a></span>, pour discuter de droits fondamentaux en milieu de travail pour les personnes aux prises avec des troubles mentaux et des dépendances. Ces organisations envisagent de créer des outils qui aideront les commissions des droits de la personne et les employeurs à traiter des questions touchant les droits de la personne et l’accommodement au travail pour les personnes ayant des troubles de santé mentale.<o:p></o:p></span></p><p class=MsoNormal><span lang=FR-CA><o:p> </o:p></span></p><p class=MsoNormal><span lang=FR-CA>En avril, nous avons donné à des arbitres des <span style='color:blue'><a href="http://www.elto.gov.on.ca/english/default.html">Tribunaux de l’environnement et de l’aménagement du territoire Ontario</a></span> une formation sur l’obligation d’accommoder les personnes ayant un handicap invisible, dont des troubles mentaux. <o:p></o:p></span></p><p class=MsoNormal><span lang=FR-CA><o:p> </o:p></span></p><p class=MsoNormal><span lang=FR-CA>En mai, nous avons été présents et avons fait une présentation à la conférence intitulée <i>Mad-Positive in the Academy: An International Dialogue on Practice</i> organisée par la <a href="http://www.ryerson.ca/ds/">faculté d’études de la condition des personnes handicapées de l’Université Ryerson</a><span style='color:black'>. </span>Des militants et des universitaires de quatre pays ont discuté de théories et de pratiques liées à la « folie », notamment sur l’inclusion dans les programmes d’études des connaissances des chercheurs acquises auprès d’usagers ou de survivants. Nous nous penchons sur de nouvelles occasions de partenariat avec la faculté d’études de la condition des personnes handicapées de l’Université Ryerson.<o:p></o:p></span></p><p class=MsoNormal><span lang=FR-CA style='color:black'><o:p> </o:p></span></p><p class=MsoNormal><span lang=FR-CA style='color:black'>En juin, nous avons présenté à l’hôpital Sunnybrook un atelier d’une journée sur la gestion de l’amassement pathologique dans la collectivité.
