EQUITY RESPONDS TO CHANGING WORKPLACE INTERIM REPORT - ONTARIO

The live performance sector is composed of a transient workforce, one in
which workers perform in multiple contexts, quickly change from worksite to
worksite and constantly shift work environments.
In the fall of 2015 Equity appeared before the Ontario Changing Workplaces
review panel. The Association made several recommendations based on our
members' long history with non-standard working relationships.
An Interim Report was released identifying a range of options to amend
Ontario’s Labour Relations Act, 1995, and Employment Standards Act, 2000 to
better protect workers while supporting business in today’s economy.
Equity was pleased with the attention that was given to the arts sector. The
report seeks to offer options for addressing ever-increasing workplace
precarity in Ontario with specific reference given to Status of the Artist
Legislation (SOA),a labour relations model that has worked well in other
Canadian jurisdictions.
In its response to the Interim Report, Equity supports developing SOA
legislation in Ontario. The Association further identifies necessary
concepts including oversight mechanisms to better compel negotiations and
increased flexibility in respecting mixed bargaining units (independent
contractors and employees) that artists fall under.

Equity sees the Quebec version of SOA as a “roadmap” that the Ministry
should adopt and modify for the Ontario context
