Hi Shawn,
In the most recent urban forest plans we prepared for the City of White
Rock and the District of Oak Bay we have recommended changes to their tree
protection bylaws such that the requirement would be to maintain a
percentage of canopy cover for each lot based on the zoning type (eg:
commercial industrial or residential) or land use (agricultural, riparian
edge, sensitive ecosystem, critical habitat). This is quite different from
most tree bylaws in that they only look at maintaining a certain diameter
and/or species of tree across most land uses and zoning classifications.

With this type of canopy based measurement, it is more equitable for each
lot owner (in a similar zoning classification) in that everyone must meet
the same requirement. A lot owner would not be penalized for having 90%
tree canopy cover. With traditional tree bylaws, in this situation, the lot
owner would pay for the removal of their trees and additional replacement
fees to develop their lot according to their zoning regulations. Whereas a
homeowner with only one tree on their lot might pay nothing to develop
their property in relation to their tree removals, nor have to provide any
replacement trees.

With a canopy based approach, neighboring trees and those trees located on
City property that extend onto a private property could account for some of
the canopy cover on your lot. Each lot owner would be responsible for
maintaining their tree canopy cover and it would provide indirect
incentives to maintain the health of neighboring trees as well as your own.
So each time the lot owner applies for a building or development permit,
the canopy of the lot would need to be measured by a qualified
professional. So there are incentives for the homeowner in deciding which
trees they want to plant and retain to contribute to their canopy
percentage (including their neighbors trees), to care for them and to see
them provide long lasting benefits to the community.

With such a tree bylaw, each homeowner will also begin to look at the
public trees as a resource that provides them with a contribution to their
lot's minimum tree canopy requirement. It provides an indirect incentive to
protect, maintain and value both private and public trees. Asking lot
owners to consider additional canopy cover  in relation to environmentally
sensitive areas or cultural or socially significant sites can then be
easily compensated for and justified by a municipality, in providing public
monies for tree care and management on these sites because they are
providing an amenity for the public good. This type of approach allows a
lot of flexibility in its application to different land uses (industrial,
commercial, residential, sensitive areas), ecology and
environmentally sensitive areas.
