Thanks for all the great feedback! I want to clarify this is just clearing roots from inside the pipe via cleanout, not open excavation, in case that changes your comments...

Since several people have now contacted me off line ...

It is not as simple as changing the tree bylaw. Provincial statutes also affect this issue, along with Municipal statutes, codes and policies. There is well established case law on the matter which I have described in Trees and the Law in Canada.
