[CANUFNET] Compensation for removal of municipally-owned trees

Here is the response from the Regional Municipality of York:

1.       Does your municipality seek compensation for municipally-owned trees removed through development on private lands?
York Region seeks compensation for the removal of Regional forestry assets, including street trees, removed as a result of development.
2.       If so, do you seek (A) to cover removal/replacement costs, (B) amenity value, (C) both amenity and removal/replacement, or (D) other?
The Region seeks to recover the cost to fund the replacement of the forestry asset.
3.       If your municipality seeks to recover (B or C) amenity value, do you determine amenity value using (A) the Council of Tree and Landscape Appraisers (CTLA) Trunk Formula Method (TFM), or (B) an alternate method?
The Region determines the value for compensation planting using its own Draft Tree Compensation Guideline.
4.       Can you provide some more details about the method you use (e.g., TFM by-the-book, TFM with modifications, negotiated value, etc.)?
To calculate a compensation value and/or number of replacement trees, the following formula are used:
The DBH of the removal is measured and divided by the DBH of the intended or desired replacement specimen (traditionally 5cm caliper stock). This number is then subject to a condition rating multiplier and a further species discount rate. Both the condition multiplier and species discount rate are obtained from fixed, predetermined metrics (e.g. 'if condition rating = poor then .33' or 'if Species = Manitoba Maple then Species Discount Rate = 0.5). This calculation provides the number of replacement trees (see equation a.).
To calculate the replacement cost, the above calculated number is multiplied by the total costs for planting one of the replacement specimen (planting, mulching watering etc.). This number is updated annually based on previous year's costs (equation b.).

5.       Can you provide any comments about the successes/challenges in seeking compensation for the removal of municipally-owned trees?
As the Region treats is trees as assets, not unlike any other Regional asset, it pursues compensation for loss accordingly. As a consequence, the Region has had success in recovering compensation for removal of its forestry assets.
