Some towns in urban an peri-urban, like Hudson Quebec, has two or three types of sewage systems ; in the town village and new developments, connected septic systems and sewage to public pipes and canalisation, in the older areas, no public
Serviced sewage system at all. One by law and very limited knowledge about root systems contribution to erosion and water run off. The town had fired the green space  surveyor and trained a security agent for public and private forestry issues. The situation changed a while ago as the town of Hudson is part of a considerable residential development in a wet land an beach area.

Our legal department is recommending we amend our City Tree By-law to create an exception which would allow people to cut roots of municipal trees, for the purpose of unblocking sewer laterals. We have fairly standard language that states no person is permitted to prune or remove any part of a City tree, and legal is arguing that people who clear roots from sewers are technically in violation of the by-law.

Has anyone encountered this argument and how was it resolved?
